Patricia Shore, Director

Biography

Ms Shore is a director in LECG's insurance claims practice. She has 18 years of experience providing consultation to clients on liability insurance, property insurance, environmental and bankruptcy matters, and other commercial litigation matters.

In the liability insurance coverage area, Ms Shore has managed and performed all analytical efforts, provided litigation support including coordination of major discovery, provided expert witness testimony, and participated in settlement negotiations. She has provided liability insurance services to policyholder clients in a wide variety of industries, including the electric and gas utility, mining, petrochemical, manufacturing, chemical, pharmaceutical, and transportation industries, with a particular focus on liability insurance coverage for environmental claims. Ms Shore’s work has included:

  • Site research including detailed review of site technical and historical documents, preparing site summaries, and analyzing site facts from the perspective of insurance recovery.
  • Administering the notice process including identifying and evaluating claims for notice consideration, preparing notice letters, and responding to carrier requests for information.
  • Accumulating, segregating, and analyzing past costs including conducting analyses to confirm accuracy, completeness, relevance, and reasonableness of costs; segregating costs by cost component, activities, timing, and indemnity and defense categorizations; analyzing shares of cost responsibility; and developing databases of cost information.
  • Developing estimates of future costs including “top down” studies of environmental liability exposures based on public and proprietary information on environmental remediation projects; and site-specific, “bottom up” estimates considering the nature and extent of contamination, available remedial options, applicable regulatory requirements, and other site-specific issues.
  • Locating and analyzing insurance policy information and developing databases of key policy information.
  • Developing and implementing sophisticated financial models designed to allocate costs to policies and carriers “on the risk” for specific claims, considering key insurance coverage variables such as trigger and scope of coverage, allocation and exhaustion methods, self-insured retentions and deductibles, policy exclusions, coverage defenses, and other relevant issues.
  • Preparing and submitting documentation in support of “proof of claim” packages to insolvent insurers.
  • Preparing and submitting settlement reports, developing settlement strategy, and participating in settlement negotiations.

In the property insurance area, Ms. Shore has performed various analyses related to claims for property damage, extra expense, loss of business income, and product recall. Her work has included:

  • Calculating claims for damage to physical property including identifying and documenting repair and replacement costs.
  • Calculating loss of business income including developing and evaluating calculations of potential future sales and associated expenses. 
  • Calculating extra expense claims including accumulating and documenting costs associated with extra expense items and analyzing increased costs. 
  • Preparing and submitting property insurance claims including providing testimony pursuant to claim provisions allowing examination of claim preparers in property insurance coverage disputes. 
  • Evaluating and adjusting property insurance claims for loss of business income and extra expense prepared by others.
  • Analyzing potential property insurance recovery under a variety of scenarios.

On environmental matters, Ms Shore has provided services to individual potentially responsible parties (PRPs) as well as multi-party PRP groups on a variety of sites including manufacturing facilities, hazardous waste disposal facilities, landfills, former industrial sites, and rivers. This work has included:

  • Assisting clients with responding to State and Federal information requests including researching involvement with particular environmental sites, and locating and analyzing information documenting contribution.
  • Developing waste-in databases including project definition and planning, development of technical specifications, coordination of vendor work, data evaluation and interpretation, and report development.
  • Evaluating PRP share of cost responsibility using a variety of techniques including volumetric, toxicity, cost-driver, and/or other approaches as dictated by the type of site and availability and type of contribution data.
  • Analyzing and documenting environmental cleanup costs related to remediation construction cost claims and other environmental disputes.
  • Analyzing agency response and oversight cost billings including review of detailed cost documentation; review of various methods used to allocate indirect, overhead, and other allocable costs; and assisting counsel with development of negotiation strategies.
  • Conducting land transaction analyses, corporate successorship analyses, and other technical analyses related to environmental matters.

In the bankruptcy area, Ms Shore has provided consulting services in the areas of claim resolution and Plan of Reorganization implementation. Her work has included:

  • Preparing of Schedules of Assets and Liabilities and Statements of Financial Affairs including asset and liability identification, description, quantification, and association.
  • Analyzing and resolving complex creditor claims in the environmental, trade payable, and other areas including developing an efficient and effective claims management process; establishing criteria for claims resolution; preparing appropriate claim resolution documents and negotiating with creditors; assisting with payment integrity processes; and maintaining claims data repositories.
  • Developing and implementing systems to track claim status and preparing reports to client personnel as requested for various end uses. 
  • Participating in Plan of Reorganization implementation activities including allocation of assets and associated liabilities and responding to underwriter due diligence requests for information and disclosure.

Ms Shore’s information management and litigation support experience encompasses the entire life cycle of litigation including pre-litigation planning, discovery support, and settlement support. Her work has included:

  • Supervision of large scale litigation support including managing the discovery process, document collection, relevance review, privilege review, document organization, document tracking, assistance to clients with fact-finding, preparing responses to interrogatories and discovery requests and deposition preparation.
  • Construction of document and analytical databases, including coded document databases with bibliographic and in-text treatment, and analytical databases designed to support functions such as claims tracking; cost accumulation, segregation, and allocation; and in the environmental context, assignment of responsibility at multi-party sites based on measures such as volume and toxicity of waste.
  • Development, use, and maintenance of hard copy document repositories as well as image based document retrieval systems.
  • Development of records management systems to support litigation needs as well as ongoing business activities of clients.

Ms Shore has also provided consulting services on commercial damages matters including construction claims, breach of contract claims, and other matters. Ms Shore has testified in civil court proceedings.
